Ultahost Registration Agreement
This Registrar Registration Agreement (“Agreement”) sets forth the terms and conditions governing the registration, management, and use of domain names through our services.
It defines the rights and responsibilities of the registrant, the registrar, and the applicable registry, and establishes the legal framework under which domain names are registered, maintained, and transferred.
1. Registrant Responsibilities
- You are required to provide accurate, complete, and up-to-date contact information, including but not limited to, your name, address, email address, and telephone number, and ensure to maintain updated information at all times.
- You agree to use your domain in compliance with all applicable laws, registry policies, and ICANN regulations, and to ensure that your domain is not used for abusive, fraudulent, or illegal activities, including, but not limited to, phishing, malware distribution, or spam.
2. Domain Registration
- It is only considered effective once it has been successfully processed and activated by the relevant registry operator. Additionally, domain name registrations are granted for fixed terms and remain valid only until the specified expiration date, after which renewal is required to maintain ownership and associated services.
- You acknowledge and agree that we shall not be held liable or responsible for any errors, omissions, or other actions taken by the registry administrator in connection with any request to register, renew, modify, or transfer a domain name.
3. Domain Renewal
- You are solely responsible for ensuring the timely renewal of your domain name license. If renewal is not completed before the expiration of the current term, the domain may become available for registration by the general public on a first-come, first-served basis.
- If automatic renewal for your domain name is enabled, it remains your sole responsibility to ensure that sufficient funds are available in your account to cover the renewal fees.
- Ultahost will begin sending renewal notifications 30 days prior to the domain’s expiration, and you must ensure that your registered contact information is accurate and active to receive these communications.
- A renewal will be deemed successful once you receive a confirmation notification from us. If no confirmation is received within 48 hours of the renewal date, it is your responsibility to verify the status of your domain, either by checking your website online or by contacting Ultahost directly.
- By accepting this agreement, you waive any claims against us arising from your failure to renew your domain name license.
4. Domain Expiration
- If a domain name expires, the registrant is provided with a 30-day grace period in which the domain may still be renewed. However, during this period, the domain’s DNS (Domain Name System) services are interrupted. As a result, the associated
website will become inaccessible, and any email accounts linked to the domain will be unable to send or receive messages until the renewal is completed and DNS services are restored.
5. Domain Redemption
- When a domain name expires, the registrant has a 30-day grace period to renew it at the regular renewal rate. If the domain is not renewed within this timeframe, it will move into the Redemption Grace Period (RGP).
- During the redemption period, the registrant has 30 days [from the end of the grace period] to recover the domain. Restoring the domain at this stage involves additional costs, including a restoration fee [link to domain pricing]. Failure to complete the restoration within this period will result in the domain proceeding to deletion.
- After the redemption phase, the domain enters a PendingDelete status for 5 days. At this point, the domain can no longer be restored. Once the pendingDelete phase is complete, the domain will be released and made available for registration by the public on a first-come, first-served basis.
6. Fees and Payments
- Standard Renewal Fees:
- Domain names registered through Ultahost may be renewed at the same rate as the original registration fee, depending on the applicable TLD.
- Redemption/Restore Fees:
- If a domain enters the Redemption Grace Period after the auto-renew grace period has lapsed, an additional redemption/restore fee of (Currently, $100 USD) applies on top of the standard renewal fee. This covers the cost of restoring the domain name from the registry before it is permanently deleted.
- Fees are non-refundable unless otherwise stated.
6. Registrar Transfers In
- Subject to the policies of the applicable registry operator, you may apply to transfer a domain name registration from another registrar to our services. A registrar transfer to our company is treated in the same manner as a new registration, and all terms and conditions outlined in this Agreement shall fully apply. By submitting a request for a registrar transfer, you acknowledge and agree to be bound by this Service Agreement, as well as any applicable policies established by us or the relevant registry operator.
7. Registrar Transfer Out
- You also have the option to apply for a registrar transfer of your domain to another accredited registrar. Any such transfer out is subject to the terms and conditions set forth in this Agreement, including the provisions specifically applicable to the top-level domain (TLD) of the domain name being transferred (e.g., .com, .au, etc.). By initiating a transfer, you acknowledge that all relevant clauses in this Agreement continue to govern the transfer process and your obligations until the transfer is fully completed.
8. Dispute Resolution
- You further agree to adhere to any dispute resolution policies issued by the Registry from time to time, including, without limitation, procedures related to the suspension of a domain name as requested by intellectual property rights holders, Internet security and engineering authorities, or other competent claimants, in order to maintain the security, stability, and integrity of the Registry.
You are required to:
- Comply with ICANN’s published policies regarding domain name disputes.
- Release and hold us harmless from any claims arising from actions we take, or that are taken by the registry operator, in accordance with the applicable published policies.
9. Suspension and Termination
- Ultahost reserves the right to suspend, cancel, or transfer a domain if:
- Required by law or registry/ICANN policy.
- Used in violation of this Agreement (e.g., abuse, fraud, spam).
- Registrant fails to provide accurate or updated contact details.
10. Notifications
- Notifications regarding an impending domain expiration, as well as those following expiration, will be sent via email to the contact address provided by the Registrant. It is the responsibility of the Registrant to ensure that this contact information is accurate and up-to-date to receive all such communications in a timely manner.
11. Domain Cancelation
- If your domain name license is cancelled for any reason - whether in accordance with these terms or as required by the registry operator - the domain may subsequently become available for registration by a third party. In such circumstances, you acknowledge and agree that we shall bear no responsibility or liability for the loss of the domain, and you hereby release and discharge us from any claims, demands, or actions arising out of or relating to the cancellation and subsequent registration of the domain name by another party.
12. Automatic Renewal Policy
- Your purchase includes enrollment in our automatic renewal service, which ensures that your products and services remain active by automatically charging the current renewal fees to the payment method on file shortly before expiration. This process requires no additional action on your part. While we may provide notifications to the contact information on file regarding impending auto-renewals, we are not obligated to do so.
- You may click here to disable the automatic renewal service at any time by disabling the auto-renewal feature in the Client’s Area. Please ensure that any cancellations are completed at least one calendar day before the scheduled renewal date.
- By opting into, or choosing not to opt out of, automatic renewal, you agree to be bound by all applicable terms, conditions, policies, and procedures that apply to the renewed product, as outlined in this document.
13. Prohibited Use:
- You acknowledge and agree that you must not use your domain name or associated services to distribute malware, operate botnets, engage in phishing, commit piracy, infringe upon trademarks or copyrights, or participate in any
fraudulent, deceptive, or counterfeit activities. - Furthermore, you are prohibited from engaging in any actions that violate applicable laws or regulations. Any violation of these terms may result in serious consequences, including, but not limited to, the suspension or termination of your domain name and associated services, without prior notice.
14. Acceptance
- By registering or managing a domain name through Ultahost, you acknowledge that you have read, understood, and agree to be bound by this Agreement, as well as applicable ICANN policies and registry rules.
