Uniform Domain Name Dispute Resolution Policy (UDRP)
Applies to: All domain names registered through Ultahost
Purpose
This Uniform Domain Name Dispute Resolution Policy ("Policy") has been adopted by Ultahost and is
incorporated by reference into our Registration Agreement. It sets forth the terms and conditions in
connection with a dispute between a domain name holder (the "Registrant") and any third party (the
"Complainant") regarding the registration and use of an Internet domain name.
Proceedings under Paragraph 4 of this Policy will be conducted according to the Rules for Uniform Domain
Name Dispute Resolution Policy ("Rules") and the selected administrative-dispute-resolution service
provider's supplemental rules.
Your Representations
By applying to register a domain name or by maintaining the registration of a domain name with Ultahost, you
represent and warrant that:
- The statements you made in your Registration Agreement are complete and accurate;
- To your knowledge, the registration of the domain name will not infringe upon or otherwise violate
- the rights of any third party;
- You are not registering the domain name for an unlawful purpose; and
- You will not knowingly use the domain name in violation of any applicable laws or regulations.
It is your responsibility to determine whether your domain name registration infringes or violates someone
else's rights.
Types of Disputes Subject to UDRP
A domain name registered through Ultahost is subject to cancellation or transfer in a mandatory
administrative proceeding upon submission of a complaint to an approved dispute-resolution provider, if the
Complainant proves that:
A. The domain name is identical or confusingly similar to a trademark or service mark in which the Complainant has rights;
B. The Registrant has no rights or legitimate interests in respect of the domain name; and
C. The domain name has been registered and is being used in bad faith.
Examples of bad faith include, but are not limited to:
- Intent to sell the domain to the trademark owner at an inflated price;
- Registering the domain to prevent the owner of a trademark from using it;
- Registering the domain to disrupt a competitor’s business;
- Using the domain to attract, for commercial gain, Internet users by creating confusion with thecomplainant’s trademark.
Registrant’s Rights and Legitimate Interests
Examples where the Registrant may demonstrate rights or legitimate interests in the domain name
include:
- Use of the domain name in connection with a bona fide offering of goods or services;
- Being commonly known by the domain name;
- Making legitimate non-commercial or fair use of the domain, without intent for commercial gain or to mislead consumers.
Procedure
The dispute will be handled by an approved dispute resolution provider (such as WIPO or NAF) in
accordance with their rules. The domain may be:
- Canceled
- Transferred to the Complainant
- Or the complaint may be rejected
Ultahost will implement the decision upon notification from the dispute resolution provider, unless
the losing party initiates a lawsuit in a competent jurisdiction within 10 business days.
Court Proceedings
Nothing in this Policy prevents either party from submitting the dispute to a court of competent
jurisdiction for independent resolution before or after the UDRP administrative proceeding.
Modifications to the Policy
Ultahost may modify this Policy at any time. Revised versions will be posted on our website and
will become binding upon all domain name holders 30 days after posting. If you object to any
change, your sole remedy is to cancel your domain registration. Continued use of your domain
name after the effective date of any changes constitutes your acceptance.
